BRO RIDES MOTORCYCLE GENERAL TERMS AND CONDITIONS OF SALE


These are our General Terms and Conditions for motorcycle tours. Please read them carefully before booking any tour. When you book with BRO RIDES MOTORCYCLE PRIVATE LIMITED, and pay an advance, a contract is formed between you and BRO RIDES MOTORCYCLE in accordance with the Terms and Conditions set out.

Your booking is governed by Indian law and the norms of the Indian legal system. BRO RIDES MOTORCYCLE PRIVATE LIMITED is registered under registration number U52291BR2023PTC063158.

GOOD TO KNOW
When you join BRO RIDES MOTORCYCLE, you should be aware that motorcycle tours in Asia (India, Nepal, Sri Lanka and Vietnam) can involve risks, even if you are an experienced rider. You take these risks knowingly and at your own risk. You are entirely responsible for your own safety and the operation of your motorcycle.

Before setting off, make sure you are in good health and that you have taken the necessary precautions. Consult health professionals if necessary. Tours sometimes involve long consecutive days. The roads can be difficult, even dangerous. Weather conditions can vary greatly on the same trip. Don't forget that all this can affect your physical condition, especially in hot weather or at high altitude.

To take part in our tours, a rider must have ridden powerful motorcycle on and off road for at least 3 to 4 years. They must drive competently and carefully. Although our mechanics keep the bikes in good condition, riders are responsible for the safety and maintenance of their own motorcycle. Don't forget that our tours pass through areas far from civilization.

If we find that a rider is taking unnecessary risks, we may decide to stop their journey and they will have to continue the rest of the tour in the support vehicle. In this case, no refund will be given. Your safety is our top priority.

You must follow the traffic rules laid down in each region. You will be solely responsible for paying any fines imposed on you by the authorities.

As you know, there's no such thing as bodywork on a motorcycle, and an accident presents a greater risk for the driver, even at reduced speed. So it's up to you to make up for this, particularly through your clothing. You are solely responsible for your equipment (jacket, gloves, boots, etc.). Wearing a helmet is compulsory in all Indian states, so make sure it is approved and in perfect condition. If you have a passenger, you alone are responsible for their safety. Make sure his or her equipment is in order.

The following five documents are compulsory and are the sole responsibility of the driver or customer:

(i) A valid passport with an expiry date of at least 6 months after your return to your country of origin.
(ii) Any visas required.
(iii) A valid motorcycle driving licence, translated if necessary (for drivers only).
(iv) A valid international driving licence, translated if necessary (for drivers only).
(v) A valid travel insurance policy covering your personal health, repatriation, property, and insuring you for driving a large motorcycle.

  • It is imperative that you print out a copy for safekeeping during your tour/travel. You will also need to provide our guide with your insurance policy number and the address of your insurance company.

  • These five documents are compulsory to take part in our motorcycle tours. Any failure to do so will block your participation in the tour.
  • Additional documents - In addition to the documents required, it is always advisable to take the following documents with you:
  • Photocopies of your passport and visa page, for authorisations, to purchase SIM cards and as a back-up in case of loss. (To be on the safe side, some travellers send themselves and someone they trust an email with scans of all the documents they need attached. Passport, visa, insurance, licence, etc.)
  • Important telephone numbers, for example the contact number of the credit card company (in the event of loss or theft).
  • Supplementary health insurance, if your travel insurance does not provide sufficient cover.
  • In accordance with IATA guidelines, we do not purchase international air tickets on behalf of our drivers/clients for any of our tours. However, if necessary, we can advise you.

BOOKING
A deposit of 30% per driver/passenger must be paid to BRO RIDES MOTORCYCLE no later than 7 days after the online reservation. Failure to do so will result in your booking being cancelled.
  • Payments must be made to BRO RIDES MOTORCYCLE and can be made by bank transfer, in Euros or US dollars. On receipt of the deposit, an invoice will be sent to you containing all the necessary information, including that required for the visa application.
  • Upon validation of your online booking, it will be assumed that you have the necessary authority and driving experience to take part in the motorcycle tour booked and that you accept the Terms and Conditions set out in this document.
  • The balance of 70% must be paid 3 months before the departure date of the tour.
  • All bank charges relating to the booking payments are the sole responsibility of the rider/passenger.
COSTS
  • All our prices are fixed.
  • However, a special rate may be offered if you are a group of more than 10 participants.
CANCELLATION
Should the driver wish to make any changes or cancel the booking for any reason (such as death, accident, illness or any other personal reason, including non-payment of the balance), BRO RIDES MOTORCYCLE is entitled to charge a cancellation fee. It is imperative that all cancellations and modifications are notified in writing.
Cancellation charges vary according to the number of days remaining before the departure date of the trip. Here are the details of the charges applied:
  • More than 60 days before the trip departure date: A charge equivalent to 10% of the total price, plus a €200 handling fee, will be levied.
  • Between 31 and 60 days before the departure date: A charge equivalent to 25% of the total price, plus a €200 handling fee, will be levied. Between 16 and 30 days before the departure date: A charge equivalent to 50% of the total price, plus a €200 handling fee, will be levied.
  • Between 0 and 15 days before the departure date: A charge equivalent to 100% of the total price will be levied. This means that the full amount of the booking will be retained in the event of cancellation during this period.

Reminder: All cancellations must be notified in writing.
In the event of delay or if you think you are going to be late for your journey:

  • Contact details will be made available, and all necessary steps will be taken to organise alternative arrangements to meet you further down the road.
  • Additional charges may be levied on drivers to cover the costs of alternative arrangements. Between 16 and 30 days before the travel departure date: A charge equivalent to 50% of the total price, plus a €200 handling fee, will be levied.
  • It is essential to note that no refunds will be given for no-shows. If the driver is not present at the scheduled departure point, the cancellation charges mentioned above will apply and no refund will be made.


  • Please remember to inform us in writing if you expect to be late or if you have any problems joining the journey at the agreed time.

    Changes will only be processed once they have been officially received by BRO RIDES MOTORCYCLE. However, if any of the change requests result in the cancellation of one or more services, it is important to note that BRO RIDES MOTORCYCLE reserves the right to levy cancellation charges in accordance with the above conditions.

    The above cancellation charges apply only to the main tour and optional tours organised by BRO RIDES MOTORCYCLE. If the client has booked other services such as air, rail or any other product through BRO RIDES MOTORCYCLE, the company will apply the cancellation policy of the airline, rail or other service provider to levy cancellation charges.

  • Make sure your travel insurance covers cancellations
  • Refunds will be processed within 15 to 20 working days from the date of the cancellation request. Refunds will be made by bank transfer or another method of payment, should this prove more suitable.

  • However, it is important to note that transfer fees such as payment gateway fees or bank charges, which were charged at the time of booking, will not be refundable. These charges applied by financial service providers when processing payments cannot be recovered in the event of cancellation.

    DISRUPTION
  • No refund will be given if your Tour is prematurely interrupted due to accident, physical inability to continue, dismissal from the Tour or for any other reason.
  • Leaving a Tour en route will result in the loss of your motorcycle deposit.
  • TOUR MODIFICATIONS
  • In the event of an insufficient number of riders, we reserve the right to modify the itinerary for this smaller group. However, the specific characteristics of the tour concerned will be retained.
  • Our tours are planned several months in advance and take account of the weather conditions in the region. If unforeseeable situations beyond our control arise during the tour (landslides, heavy snowfall, earthquakes, etc.), we reserve the right to modify the planned itineraries and to take the necessary steps to ensure that the adventure continues in complete safety. The safety of our travellers is our primary concern. Under no circumstances can the decision of the motorcycle expedition guide be challenged. In such rare cases, additional costs may be incurred and will be charged to the driver/passenger.

  • FOOD AND DRINK
  • We attach great importance to catering on our motorcycle tours, favouring hygienic cuisine. We sometimes opt for local meals offering authentic cuisine, although often not in accordance with your eating habits, when the routes take us into very isolated regions.
  • When we sleep in hotels, dinners will be served on site and when we are in camps, generally at high altitude, our cooks will endeavour to serve you suitable, quality meals.
  • If you have any dietary restrictions, such as allergies, or if you are vegetarian, don't forget to let us know before departure.
  • Bottles of water will be available at all times in the vehicle accompanying us.
  • For obvious reasons, the consumption of alcohol is prohibited before departure and during the rides. What's more, alcohol and oxygen levels at high altitude are not really compatible.

  • GUARANTEE DEPOSIT FOR DAMAGE TO MOTORCYCLES
  • In accordance with legal requirements, motorcycle are insured for third-party liability. However, this does not correspond to the European definition. In the event of an accident involving humans, animals or vehicles, this type of accident is not covered.
  • You will be asked to pay a compulsory deposit of €300 when you are allocated your motorcycle.
  • Payment can be made in cash or by credit card authorisation before the start of the tour.
  • Damage to motorcycle is the responsibility of the rider. In the event of damage exceeding the security deposit, BRO RIDES MOTORCYCLE is entitled to charge the costs to the rider.
  • In the event of minor damage, the costs will be deducted from the security deposit, the balance being returned to the driver if necessary.
  • If there is no damage, no charge will be made to your credit card and your cash deposit will be returned to you.
  • Repairs to minor accidental damage caused by falling motorcycle and minor accidents are normally covered by the tour price. However, BRO RIDES MOTORCYCLE reserves the right to assess the cost of damage and charge accordingly.

  • CUSTOMS AND PROTOCOL
  • Riding a motorcycle in Asia and the Indian subcontinent is a privilege.
  • BRO RIDES MOTORCYCLE thanks the Indian Subcontinent and Asia Tourism Authority for allowing us to organise motorcycle tours in Asian countries.
  • Some remote areas have only recently opened and tourism is therefore new to these regions. Participants must be aware of the culturally sensitive nature of these trips, behave in a respectful manner, show courtesy and adapt their conduct towards the local population.
  • You should also show respect and courtesy to your fellow travellers.

  • RISKS, LIABILITY AND INSURANCE
  • You must wear protective clothing and a helmet from the moment you get on your motorcycle.
  • Whether you are a driver or a passenger, travel and medical insurance is compulsory. This must cover your health, your possessions and yourself when riding a high-powered motorcycle for transport purposes. BRO RIDES MOTORCYCLE can never be held responsible for any injury or loss.
  • No one wants to get hurt or be hurt on a tour, but you should be aware that accidents do happen. Your travel insurance policy must therefore be sufficient for your health needs and cover hospitalisation and repatriation.
  • Some remote areas have no mobile signal and no helicopter or ambulance rescue service available. The tour leader will ensure that the best possible evacuation/services are provided according to local availability.
  • Your insurance may cover helicopter rescue. However, please be aware that the difficulties associated with altitude and isolation may require us to send a messenger back to find a network and telephone and call a helicopter, assuming the nearest one is in working order - This generally applies to the most remote mountain tours.
  • We also ask you to provide emergency contact details in the unfortunate event of something serious happening to you. We will inform this contact of your condition as soon as possible.

  • BEHAVIOUR ON THE TOUR :
    We have the full right to exclude you from the tour without notice and without refund, if your behaviour:
  • Is unpleasant and dangerous to the group or any person with whom we come into contact during the tour.
  • Causes excessive damage to the motorcycle or the premises where we are staying.
  • Is racist, contemptuous or humiliating towards anyone.

  • WARNINGS
    Exploring the rich cultures and unforgettable landscapes of the Himalayan and Nepalese regions is undoubtedly an exceptional motorcycling experience. However, you should be aware that motorcycling in these mountainous regions is not without its risks, particularly on narrow, winding roads with unpredictable traffic and extreme and changeable weather conditions. The tours offered by BRO RIDES MOTORCYCLE are designed for experienced riders who are in excellent physical condition and able to adapt to changing conditions and varied driving rules. We promise you an experience to remember for life, and an extraordinary adventure in Asia and the Indian subcontinent.

CONDITIONS - VISA
Your passport must be complete and valid for at least 6 months after your return to your country of origin. The immigration authorities are very strict about the validity of valid visas. Take every precaution to ensure that your visa does not expire during your stay.

Visas for India -

To enter and travel in India, you only need a "single-entry Indian tourist visa", which is valid for up to 6 months and can be obtained from the Indian Consular Service, www.vfsglobal.com You can configure the site to suit your country and language and obtain information on obtaining an Indian visa.

• We do NOT recommend e-visa as it does not allow travel to remote areas of India.
• Indian Multiple Entry Tourist Visa: You should be aware that you must stay out of India for at least 2 months after leaving the country before you can re-enter, and this rule is strictly enforced.


Visas for Nepal -

Visas on arrival in Nepal are valid for 60 days and can be renewed in Kathmandu or Pokhara for a further month. The total duration can only be 150 days (5 months) per calendar year. The cost at one of the border entry points is US$40 per month. A renewal visa for Nepal will cost US$60 for one month.


Visas for Sri Lanka -

The ETA (Electronic Travel Authorisation) is compulsory and can be obtained online or for an additional fee on arrival at the airport. Please visit www.eta.gov.lk for more details.


Visas for Vietnam -

The e-Visa for Vietnam is compulsory for most travelers and can be obtained online. For eligible travelers, a visa exemption is available for stays of up to 15-30 days. Please visit www.eta.gov.lk for more details.

  • The contract between you and BRO RIDES MOTORCYCLE is based on the Terms and Conditions set out in our Terms and Conditions.
  • We have full rights to alter travel itineraries due to natural uncertainties without prior notice.
  • Please do not hesitate to ask any questions you may have regarding our Terms and Conditions.

  • In consideration of payment for the right to participate in a motorcycle tour organised by BRO RIDES MOTORCYCLE, the rider EXPRESSLY DECLARES PERSONAL RESPONSIBILITY FOR SAFETY AND ASSUMES ALL RISKS, WHETHER KNOWN OR NOT.
  • The rider WAIVES ANY AND ALL CLAIMS, PRESENT OR FUTURE, and releases BRO RIDES MOTORCYCLE, its officers, employees, guides, agents or representatives from any and all liability for personal injury, death, property damage or loss arising out of or in connection with the rider's participation in the motorcycle adventure with BRO RIDES MOTORCYCLE.
